Professional Responsibility/Ethics Defense for Attorneys
An attorney's reputation is his or her most precious possession. Any allegation of misconduct, no matter the basis, can damage your reputation, compromise your practice and lead to reprimand, censure, suspension or even disbarment.
If you are an attorney who has been accused of misconduct, it is extremely important to discuss your situation with a lawyer who understands professional responsibility and attorney misconduct defense. The rules are different and this is not a good time to be representing yourself.
I am Samuel J. Muldavin, Attorney at Law, a Memphis lawyer who defends attorneys whose reputations or law licenses are in jeopardy. This area of my practice includes:
- Defending against allegations of misconduct at all stages of the disciplinary process
- The attorney disciplinary process
- Risk management consulting for attorneys and law firms
Over the past several years, it has been my privilege to represent and defend my colleagues in disciplinary matters before the Tennessee Board of Professional Responsibility. I am proud to be a lawyer to whom other lawyers come for help and it gives me great satisfaction to protect my clients' reputations and help preserve legal careers.
It Can Happen to Anyone
It is becoming increasingly common for an attorney to receive a notice of client's complaint to the Board of Professional Responsibility. While complaints sometime allege serious attorney misconduct, most occur because of a client's misunderstanding regarding the lawyer's handling of the case or even simply because the client is unhappy with the outcome.
Regardless of the gravity or the merit, each complaint must be taken absolutely seriously and dealt with calmly and knowledgeably in order to minimize any potential risk to your law license and your ability to practice law in the future.
If you have received a complaint against you, do as you would advise anybody with a legal problem to do, that is, seek qualified legal counsel immediately. Call me at 901.730.4912 to schedule an appointment or contact me by e-mail.
Assisting Attorneys to Minimize Risk and to be of Better Service to their Clients
Defending professional responsibility/attorney misconduct cases has taught me that most misconduct complaints arise not so much out unethical law practice but from inefficient practice of the business of law. By advising attorneys on how they can better manage of their cases and maintain regular and effective communication with their clients, I can assist them in being of better service to their clients and minimizing the risk of complaints of misconduct.
